I know, I LOL'd because he or she accused doglady of editing the rest of the hatemail to make them seem stupid, and then his hatemail was posted in it's original good-grammar format.

Sad thing is, they would never see it that way. They got some awfully big rose colored glasses and rarely ever take them off to see what reality looks like.

Laura, simply put - your argument holds no water. PETA has a shirt design for the Olympics that is a parody of the Toronto Olympic Logo of Inutuck bludgeoning a seal. This shirt was designed to show protest of the seal slaughter going on in Canada.
 
When the Canadian officials pulled a cease and desist order on the sell of the shirts, you wrote a letter back clearly demanding that you had a right to sell it under Fair Use laws and that it was a parody. Though you have changed the design slightly to show the attack, it STILL clearly the character, and therefore is a violation fo copyright on that ground.
 
That my dear is JUST the same as copyright - it's NOT protected under fair use laws and frankly you'd be sued for the use of the logo - even parodied. In fact, the Fair Use claim is misinterpreted - fair use allows someone to copy a portion of text - with sources cited - for works such as essays for personal use. It also does not allow for the person or group to sell the work. In fact, the claim of Fair use would be thrown out for that very reason had you sold the shirts.
 
You also consistently parody copyrighted - and I DO mean truly copyrighted: lock, stock and barrell (or excuse me for the non-gun types, roots, flowers and leaves). KFC, Burger King, McDonald's - photos and slogans, doesn't matter, you are in the same violation of the rules that you are claiming this site is in violation of.
 
If you're willing to stop doing the "McCruelty," "Kentucky Fried Cruelty," and other ads, I'm sure this group would be willing to remove the chicken emblem. (Oh, and it'd have to be ALL of them, not just one or two).

some things to consider.
1) This is an appeal to fear. Shes saying that because the site owner (Doglady, formerly London) is trying to expose Peta for what they are, they will burn for all eterity in hell. This is basically a scare tatctic.
2) Not everyone is a Christian. Some people have different faiths or may be atheists. Some may perhaps be Pastafarians (Thouched by His Noodle Appendage). Use the scare tatctic of hell may not apply to soem people.

As a Christian, I find this hilarious.

1) The scare tactic of hell doesn't affect me, since I'm saved
2) PETA is apostate according to the Bible (1 Timothy 4:1-5)
3) Jesus ate fish (Luke 24:41-43) and had to eat the passover lamb to follow Jewish law
4) Jews had to follow the Jewish law too, so they ate the passover lamb
5) Animal Rights is against God's plan of man having dominion over animals in Genesis 1
6) Responsible animal ownership is referenced in Proverbs 12:10

And that's just the tip of the iceberg. Seriously. Christianity and Animal Rights do not mix.

Oh, and "Thou shalt not kill"? (Which means murder. You can compare scripture with scripture if need be.)
I guess it takes meat to make a good troll too. Who knew?

Fair use is not JUST quiting and citing text alone, you are wrong here. Fair use is something that isn't actually defined in concrete, but with the decades, legal cases have shaped fair use.

If you are writing a review of a book, of course, the classic example is quoting passages in a book, but fair use has been expanded to include small portions of audio/video and graphics for review.  Fair use also covers criticism and parody - not PeTA's wholesale copying of Mario & Luigi for that really shitty flash game, like Family Guy being able to do all those parodies of 80s/90s tv shows, music, movies,  etc.  Wonder why they don't get sued?  Or anybody who pokes fun at any of those things?  Fair use also covers the copying of legally aquired media (video, songs, etc) for personal use and backup/archival purposes, something long established since betamax, but trickier since they also made it illegal to exercise fair use if you needed to bypass copy-protection technologies.
 
A company sending a C&D doesn't automatically make the work actually infringing - it just means they are trying to stop something they don't like, regardless of the legal merits or lack therefore.

Yes, but the logo alone isn't the issue - it's the OLYMPIC RINGS. ;)
 
The rings are a liscened item, and unlike other things that can be parodied, the logo is only to be used on official Olympic gear. This is something that PETA doesn't have authorization to do - and I doubt they'd pay the money (or the Olympics would take it), to use it.
 
Additionally, laws in the United States are different than Canada, and as far as I know the fair use laws are not the same.
 
Third - if PETA wants to pull it on groups parodying their logo as "copyright infringement" then they CANNOT parody others' logos and designs and use them for their benefit. It's the exact same thing.
 
One more thing - as far as shows and such, from what I'm seeing, they do pay a royalty to use a likeness of the show as a parody nowadays. That's why they have to pay royalties for even covers of songs - much to my detrement for a series I like watching, where the changes affected two episodes in particular.

I think they've realized that they can't be declaring that one can't use their logo in parody and that if they did it's infringment when the argument can be used - quite clearly - against them in return. ;)
 
Well - that and they think they're better than us so why bother trying to challenge the 'simple minded' people who usually if not always kick their butt in the debate.
